This website is operated by Lemon Sky Photography Ltd T/A LSP Actions (also known as LSP Actions by Lemon Sky). Throughout the site and within these terms of service, the terms "I", "me", “we”, “us”, "my" and “our” refer to Lemon Sky Photography Ltd T/A LSP Actions (also known as LSP Actions by Lemon Sky). We offer this website, including all information, tools, products and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

END-USER LICENCE TERMS
On successful completion of checkout using our website you are automatically granted the licence to use your purchased product. This licence is for you and you alone. You may install and run the product on more than one computer but only on computers belonging to you and used only by you.
You are not permitted to alter, sell, re-sell, mirror, redistribute, transfer or take ownership of any LSP Actions products in any way, or to share LSP Actions products with any organisation, individual or entity by any medium or means, whether for profit or not for profit.
You are not permitted to copy or imitate any LSP Actions products in any way.
You are not permitted to modify, decompile, attempt to decompile or reverse engineer any LSP Actions products.
You are not permitted to remove or attempt to remove any copyright or other proprietary notations from any LSP Actions products.
Anyone found to be in breach of these terms will be permanently banned from using our services and may face legal action. English Law applies.

Our products are digital downloads. Once you purchase and download a product, you own and keep it for life so it cannot be returned. However, customers may request a refund under the following circumstances:
If, within 10 days of purchase, you don't love your purchased product or have any issues at all, please reply to your order confirmation email and describe your issue. We will endeavor to help with your issue and may require further information and co-operation from you during the troubleshooting phase. If you still don't love your product after we have assisted you with any issues and provided you initially contacted us about any issues within 10 days of the order, then we will refund you.
We cannot be held responsible if you failed to check that the product is compatible with your software or if you failed to check that the product is best used with English versions of the software.
We cannot be held responsible for those purchasing who do not know how to use the product they have purchased / those who purchase the wrong product by mistake / those who update their software and can no longer use the digital download or those who use the wrong software for their purchased product.
We cannot be held responsible for those who do not know the basics of how to use the software (for example, Photoshop or Lightroom) or who have not read the product description properly.
LSP Actions does not accept liability for future updates to the software needed to run any LSP Actions products. Your purchased product is guaranteed to work with Adobe Creative Cloud at the time of purchase. Any future changes to the software that renders any LSP Actions product redundant or has any detrimental effect on the performance of the product are not the responsibility of LSP Actions and no refunds will be considered. LSP Actions will endeavor to provide upgrades and updates to match changes to the Adobe Creative Cloud software, but this is not mandatory and is at the discretion of the creator.Your statutory rights are not affected.

We, Lemon Sky Photography Ltd T/A LSP Actions and LSP Actions by Lemon Sky, use Shopify to manage orders and store personal information. When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address to form your account. We also track data collected from your time spent browsing the website.
When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
Email marketing (if applicable): With your prior permission only, we may send you emails about our store, new products and other updates. You will only receive emails of this nature if you have previously signed up and consented to the LSP Actions newsletter/mailing list. You can opt out of receiving messages from LSP Actions at any time by clicking the link in the email. Alternatively, if after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at firstname.lastname@example.org.
If you have not consented to receive email marketing but have purchased a product from LSP Actions, you will only be contacted regarding your product (including but not limited to: Updated product downloads, bug fixes, changes to the product and anything else related to your purchase).
You consent to the LSP Actions Terms and Conditions upon placing an order and completing the Checkout process. You are able to email us directly at email@example.com to request we remove your full information from our system at any time.
PERSONAL INFORMATION WE AUTOMATICALLY COLLECT
When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”. We can only collect Device Information automatically if this is enabled on your browser.
We collect Device Information using the following technologies:

_session_id, unique token, sessional, Allows Shopify to store information about your session (referrer, landing page, etc).
_shopify_visit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider’s internal stats tracker to record the number of visits
_shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer.
cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart.
_secure_session_id, unique token, sessional
storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.
PREF, persistent for a very short period, Set by Google and tracks who visits the store and from where
- “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
- “Web beacons”, “tags”, and “pixels” are electronic files used to record information about how you browse the Site.
- “Google Analytics”, which collects data and records information in the same way as above.
Additionally when you make a purchase through the website, we collect and store certain information from you, including your name, billing address, shipping address, email address, and phone number. We refer to this information as “Order Information” and this can be removed from your account if required. Our secure payment gateways will store payment information (including credit card numbers and PayPal information) which we do not have access to directly. If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

HOW DO WE USE YOUR PERSONAL INFORMATION?
We use the Order Information that we collect generally to fulfil any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:
- Communicate with you regarding your order;
- Screen our orders for potential risk or fraud; and
- When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
- Send you updated versions of your purchase if applicable.

Our store uses Google Analytics to help us learn about store visits and the pages being viewed.
